Terms of Service
Last updated: the current platform version. These terms explain what Fresh Chapter is, what it is not, and the rules that keep the community safe.
1. Who you are contracting with
The seller's full legal business name is Fresh Chapter (“Fresh Chapter”, “we”, “us”). Fresh Chapter owns and operates this platform and can be reached at support@freshchapterapp.com. These terms form a binding agreement between you and Fresh Chapter.
2. Acceptance of terms
By creating a Fresh Chapter account, or by continuing to use the platform, you agree to these terms and to our Privacy Notice. If you do not agree, do not use the platform. You must be 18 or older, or have authority to bind the organisation you represent.
3. Nature of the service
Fresh Chapter is a life coaching and personal development platform and does not provide clinical mental health therapy or emergency services. In case of crisis, call 988 or 911.
4. Accounts and eligibility
You must provide accurate information and keep it up to date, keep your credentials confidential, and you are responsible for all activity under your account.
5. Coaching relationships
Coaches are independent professionals. Fresh Chapter facilitates matching, scheduling, notes and payment, but does not supervise the content of coaching conversations.
6. Acceptable use and community conduct
Support circles are moderated. You must not use the platform unlawfully or fraudulently, send spam or solicitations, infringe anyone’s intellectual property, harass or dox other members, share another member’s private information, or interfere with the security of the service (including malware, probing, scraping, reverse engineering, or circumventing plan limits). Violations may result in removal.
7. Intellectual property
Fresh Chapter and its licensors own the platform and everything in it — software, designs, content, documentation, the Fresh Chapter name and logos. You receive a limited, non-exclusive, non-transferable right to use the platform within the plan you have purchased; nothing here transfers ownership, and you may not resell, redistribute or create derivative works from the service. You keep ownership of the content you submit (journal entries, messages, posts) and grant us only the limited licence needed to host and process it in order to provide the service.
8. Orders, payments and our reseller
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all Fresh Chapter customer orders. Paddle processes customer payments, calculates and remits applicable taxes, issues invoices, manages subscription billing and cancellations, provides payment-related customer service, and handles returns and refunds. Payment, billing, currency, tax and cancellation mechanics are governed by Paddle’s Buyer Terms at https://www.paddle.com/legal/checkout-buyer-terms. Stripe is not used to charge Fresh Chapter customers; it is used separately only to send payouts to coaches.
9. Plans, renewals and refunds
Paid memberships and coaching plans renew automatically each billing period at the price shown at checkout until cancelled. You can cancel at any time from Billing & Plan; access continues until the end of the period you have paid for. 10. Privacy and security
We apply HIPAA-aligned safeguards including row-level access control, automatic session timeouts, redaction of sensitive data from telemetry, and an immutable audit trail. Our Privacy Notice explains what we collect, why, and who it is shared with.
11. Service availability
We work to keep Fresh Chapter available, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law we disclaim implied warranties, including merchantability and fitness for a particular purpose.
12. Suspension and termination
You may close your account at any time. We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination you may request an export of your data before it is deleted.
13. Limitation of liability
To the fullest extent permitted by law, Fresh Chapter is not liable for indirect, consequential or special damages, including loss of profits, data or goodwill, and our aggregate liability is limited to the fees you paid in the twelve months before the claim. Nothing here excludes liability for fraud, death or personal injury where the law does not allow it.
14. Changes
We will notify you in-app before material changes take effect and record your acceptance with a timestamp.
